188: Clause 109, page 125, line 37, at end insert “, or (iii) included such a requirement but that requirement did not apply in relation to pre-1997 service in respect of which the compensation is payable.”Member’s explanatory statement This amendment makes clear that sub-paragraph (2B) of paragraph 28 of Schedule 6 to the Pensions (Northern Ireland) Order 2005 (inserted by this clause) applies also to a case where a pension scheme required pre-1997 indexation but that requirement did not apply in relation to pre-1997 service in respect of which the pension compensation is payable.
