The difference with my amendment today is that it places a duty on the Secretary of State to derogate from the ECHR where our Armed Forces are engaged in a significant overseas operation; in other words, we have moved from a “may” to a “must”. This, of course, does not alter that fact that the United Kingdom could make a derogation under Article 15 regardless. I submit that, for the sake of our Armed Forces, we have to move from “could” to “must”.
