All this has happened despite the fact that the Human Rights Act and the convention were not originally intended to apply to operations outside a state’s own territory. During our debates on Clause 12 in 2021, the noble Lord, Lord Faulks, whom I am very pleased to see in his place, gave a detailed history of how we got to a position where the convention was held to apply extra-territorially as a result of the Al-Skeini ruling in 2011. In my view, that was a decision which has warped the application of the convention to such a degree that it has permitted the deployment of the convention to launch wholly unjustified attacks on our troops serving in conflicts.
