These regulations establish the necessary legislative powers by amending Section 100 of the Energy Act 2008. Without this amendment, the Secretary of State would not have the statutory basis on which to include heat batteries within the boiler upgrade scheme framework in future. Subject to Parliament approving these changes, the Government intend to bring forward further amendments to the boiler upgrade scheme regulations to support eligible heat batteries through the scheme.
