Public Office (Accountability) Bill

Contribution

My Lords, I thank the noble Lords, Lord Wills and Lord Alton, and the noble and learned Lord, Lord Keen of Elie, for their contributions. The Minister talked about the subsections in Clause 2 on the duty of candour and assistance, but they refer to information more generally as opposed to formal records. The object of these amendments concerns formal records, so I wonder if, between Committee and Report, we might have a meeting. I ask the Minister to think again about the principle of what “records” means in terms of justice, as opposed to a very senior official being asked if he or she has any information on a particular topic. My concern is that we need to be specific. In the examples I gave, it is quite possible that if the police notes had been kept, the official would have been able to say, “Oh yes, I have seen that there is a file that has the police notebooks in it.” If you just ask if there is information, however, you will not get that response at all.
