This amendment is consequential on amendment 3. It replicates the provision currently made by clause 5(4) of the Bill, which as a result of the omission of clause 3 would apply only in relation to trials conducted without a jury in accordance with the new Part 6A of the Criminal Justice Act 2003 to be inserted by clause 4 (complex or lengthy cases).
