Courts and Tribunals Bill

Contribution

Section 108S of the Magistrates’ Courts Act 1980, inserted by Schedule 2, provides that rules of court must provide for the audio recording of trials and sentencing hearings in magistrates’ courts. The amendment would clarify what constitutes a trial for these purposes, and exclude proceedings conducted under the single justice procedure (which take place in the absence of the parties and without hearing oral evidence).
