Courts and Tribunals Bill

Contribution

Section 113(2) of the Magistrates’ Courts Act 1980 provides that, where a person is granted bail by a magistrates’ court pending an appeal to the Crown Court, the person must surrender to the Crown Court at the appeal hearing. As there may not be a hearing if permission to appeal is refused, this amendment would enable the Crown Court to determine when and where the person must surrender: for example, the Crown Court could require the person to surrender to the magistrates’ court.
