For supporters of decriminalisation, the rationale offered is that the criminal law is a blunt instrument, and that the prosecution of women is distressing and counterproductive. But even if one accepts that rationale, it does not follow that the law should operate without limit, without boundary and without any moral horizon. Even if this House is prepared to draw the line of criminal liability differently from the 1967 Act, surely it cannot be said that we should eliminate that line altogether.
