Northern Ireland Troubles Bill (Carry-over Extension)

Contribution

I thank the Secretary of State for his intervention, but I was coming on to that. I am told, as he has just told me again, that the reason we have a Committee of the whole House is that we need to include our colleagues who represent Northern Ireland. However, I do not see why that absolutely legitimate point could not have been addressed by the three major parties giving up some of their places to MPs who represent Northern Ireland constituencies—a solution that I suggested, but that the Secretary of State ignored. This legislation will have profound consequences for victims and veterans. Getting it right is essential to maintaining the confidence of communities across Northern Ireland, and the confidence of current and former members of the armed forces. Our amendments propose clear statutory safeguards to prevent repeated investigations, unless there is materially new evidence that is certified as necessary and proportionate. They establish a presumption of remote participation, so that veterans are not compelled to relive traumatic experiences in person unless it is strictly essential. They also provide for anonymity, proper welfare support and regulated contact through official channels. Additionally, our amendments seek to ensure that veterans’ views are properly represented, including by guaranteeing veterans a place on the victims and survivors group. We would also establish an independent reviewer, who would report annually to Parliament. This would ensure that protections were consistently applied, properly scrutinised and upheld in practice. The Government’s amendments do indeed seek to address many of those points, but we need to work through the detail of the drafting before we can say whether they achieve what is needed. For example, the clause requiring compelling new evidence to exist, or be reasonably expected to exist, before a witness can be contacted is already giving us cause for concern, as the director of investigations will be the sole judge of his own decision.
