When assessing, for example, the mental capacity of the person, the noble and learned Lord suggests that the Mental Capacity Act is tried and tested. Yet expert evidence from Professor Martin Vernon says that assessing capacity remotely, especially for a person with mental needs, is “nigh-on impossible”. He is a professor; I suggest that he too has some experience in this field. In his oral evidence to the Select Committee on 29 October, he said:
