Northern Ireland Troubles Bill

Contribution

The Secretary of State refers to new clause 32, which introduces certain protections in respect of the security forces in regard to the legacy commission and to inquests. For example, it allows their training and experience to be taken into account, the orders that they had to be taken into account, whether it appeared that they were at risk of harm, and so on. All of that is good, so why do the same provisions not extend to cover any trial of such a person, should that occur? If it is right for the legacy commission and coroners to take those matters into account, why is it not right for a Diplock court also to take them into account, if it were investigating a criminal trial?
