The case of Soldier B illustrates the problem. In 2024, a coroner’s inquest ruled that the lethal force he used was “reasonable and proportionate”. Despite that, appeals have been heard in the High Court, the Court of Appeal, and now possibly the Supreme Court. That has all been facilitated by legal aid, with state resources spent hounding Soldier B, who has suffered years with the continued stress of sleepless nights, even though a High Court judge branded the case as “ludicrous” and “utterly divorced from reality”.
