Northern Ireland Troubles Bill

Contribution

The Government must not unwittingly facilitate lawfare against those who served if they want to maintain the confidence of veterans and active service members. The Secretary of State has placed great emphasis on the assurance that repeat investigations will not take place unless they are “essential”. To that end, the Government have imposed a duty on the director of the legacy commission to give “particular weight” to whether compelling new evidence is known or reasonably suspected to exist before obliging a witness to be interviewed. That is simply not good enough. It is a factor to weigh, not a test that must be met, so the director could still compel a veteran who had already given evidence to do so again.
