Northern Ireland Troubles Bill

Contribution

However, justice also has to be fair, and those who served made split-second decisions, as was brilliantly expounded by the hon. Member for South Shropshire (Stuart Anderson). Those are conditions that many people cannot imagine, and where people have made decisions, been investigated for those decisions and been found innocent, we cannot then try them again without materially new evidence—investigation-changing, outcome-changing evidence—being brought to light. Amendment 103 ensures that is the case. It means that the file cannot be reopened by a different team, or the same questions be put to the same soldiers. It requires genuinely new evidence, and it draws a sharp line between justice and harassment.
