Causing Death by Dangerous or Careless Driving: Sentencing

Contribution

The hon. Lady raises a wider point about defendant conduct during a criminal investigation and how that should be taken into account in the sentencing. There are mechanisms by which that is done already. The judge considers a large number of factors, including whether the defendant has taken responsibility for their actions. If they have undertaken a “no comment” interview consistently, and simply not engaged with the criminal investigation process, that should be taken into account in sentencing.
