192: Clause 50, page 117, leave out lines 5 to 22 and insert— “(1) If the Secretary of State is satisfied that the proprietor of an Academy has breached a duty imposed by Academy arrangements, the Secretary of State may give the proprietor such directions as the Secretary of State considers appropriate to secure the proper performance of the duty.”Member's explanatory statement This amendment limits the Secretary of State’s power to direct the proprietor of an Academy to cases where the Secretary of State is satisfied that the proprietor has already breached a duty imposed by Academy arrangements.
