This amendment is intended not to remove necessary flexibility from the Secretary of State but to understand how that flexibility will be exercised in practice. Clear guidance on this point would give trustees and providers confidence and help ensure that the clause operates fairly and predictably. I therefore hope that the Minister can provide some reassurance in response.
