However, I add that it is not accurate to characterise the mandation power as simply giving effect to an agreed industry approach if the definition being mandated is not the one the industry actually agreed to. If the Bill diverges from the Mansion House Accord, it would be mandating a different outcome. The Government should not present industry support for the accord as support for this power as currently drafted. This is not a technical point; it goes, I believe, to clarity, consent and the credibility of the policy itself.
