421: After Clause 151, insert the following new Clause— “Removal of Chief Constables(1) The Police Reform and Social Responsibility Act 2011 is amended as follows.(2) In section 38 (Appointment, suspension and removal of chief constables), after subsection (4) insert—“(4A) Before exercising the power under subsection (3), the police and crime commissioner must consult with His Majesty’s Inspectorate of Constabulary and Fire and Rescue Services, or relevant successor inspectorate.”.”Member’s explanatory statement This amendment requires a Police and Crime Commissioner to consult with His Majesty’s Inspectorate of Constabulary and Fire and Rescue Services before calling upon a Chief Constable to resign or retire.
