Since the legislation was passed, very few accreditations have been made by the police despite much effort in seeking them. I can well understand why the police were reluctant to accredit. It would make it an offence for a motorist not to comply with instruction from a self-escort person, even though it would not be obvious that police powers were being exercised. It would cause all sorts of difficulties to take such cases to court if necessary. Furthermore, I can see how it would be akin to giving a blank cheque to a self-escorter. For these reasons I have tabled Amendment 404, which would delete paragraph 9(1) of Schedule 5 to the Police Reform Act 2002.
