4: Clause 1, page 2, line 24, leave out from “child” to end of line 26 and insert “a local authority must, so far as is reasonably practicable and consistent with the child’s welfare— (a) ascertain the child’s wishes and feelings regarding the exercise of those functions, and(b) give due consideration (having regard to the child’s age and understanding) to such wishes and feelings of the child as the authority has been able to ascertain.”Member’s explanatory statement This amendment would ensure that local authorities will take into account the wishes and feelings of a child when making decisions about family group decision-making in relation to the child under section 31ZA of the Children Act 1989 (as inserted by clause 1).
