I would also be grateful to know from the noble Lord, Lord Carlile, whether the capacity test has been consulted on. Has he spoken to the Royal College of Psychiatrists, or to Alex Ruck Keene KC of the CLADD group, which has expertise in mental capacity law? How does that test sit together with the mental capacity references which survived the clause stand part cull of 16 clauses?
