Given that there was a court process in the Bill in the first place and it was said that that was the strong safeguard—I listened to the argument set out by the noble Lord, Lord Carlile—I am persuaded that having a judicial process is much better than the panel process. I was also struck by what my noble and learned friend Lord Garnier said about the importance of having a proper system of record and precedent so that decisions can be taken by higher courts and guidance can be provided to judges and courts of first instance. The proposed appeal mechanism and way of making decisions is very helpful.
