4: In subsection (2), after inserted subsection (3B), insert— “(3C) Failure to comply with a duty under subsection (3A) may result in a fine of £39,000 for each 24 hour period following the 48 hours allowed to take the content down, payable to OFCOM.(3D) The fine payable under subsection (3C) may be increased by OFCOM following a review.”Member's explanatory statement This amendment provides an alternative to business disruption measures under the Online Safety Act 2023, so that fines can be levied more quickly, to incentivise content removal to happen faster.
