79: Clause 29, page 55, line 16, at beginning insert “Subject to section (Exclusion from automatic release following fixed-term recall for specified serious offences),” Member’s explanatory statement This is connected to Lord Marks’ amendment to after Clause 29, and his amendments to page 55, line 26 and page 55, line 30. Together they ensure that there is flexibility in the number of days a prisoner may be recalled for in relation to less serious offences, while also ensuring that those who had committed certain serious offences are not eligible for automatic release following a fixed term recall.
