The Minister’s letters of 22 and 23 December are also, I am afraid, in apparent contradiction. The letter of 22 December says that prerogative Orders in Council are not statutory instruments. The letter of 23 December, in response to the Delegated Powers Committee, says the following of the Orders in Council:
