As I have already mentioned, Amendment 37 relates to the disapplication of the Statutory Instruments Act. For the reasons I have just explained, I accept that the orders will not fall under that Act, but Amendments 34, 35 and 36 would ensure that the orders made are subject to parliamentary scrutiny in the form in which the Delegated Powers Committee recommended— Henry VIII powers being subject to an affirmative procedure, and any other orders being subject to a negative resolution procedure.
