16A: In paragraph (ca), leave out “been” and insert “had an application to be” Member’s explanatory statement This amendment would ensure that someone who so lacks capacity in one area that an application has been made to deprive them of their liberty will not be found to have capacity for the decision to seek assistance to end their own life, which is otherwise a legal possibility under the Mental Capacity Act 2005’s approach to capacity.
