A requirement to submit a business plan to the Lord Chancellor for approval is an interference with those careful arrangements for the Sentencing Council that were explained by the noble and learned Lords. The noble and learned Lord, Lord Thomas, said at one stage in his speech that they were hurried, but he also explained how they produced a careful constitutional balance, with late-night caution brought to bear and a carefully worked out, delicate mechanism.
