I think I know, deep down, the difference between “capacity” and “ability”. Just recently, I have been working with a relative who has been trying to understand what the doctors are asking her. She certainly has the capability to understand it—she is capable in every way under the Act—but, until now, she has not had the ability to do so, and I am not sure I have had the ability to explain these circumstances. There is no doubt that, in common parlance, the word “ability” has a different meaning from the word “capability”.
