This Committee has to remember that we are producing legislation that will not be easy. Many people have said that. The answer to them has been, “Well, if it’s so difficult, perhaps we ought to narrow it and just have this word”. I do not think that is a very good argument. If it is very difficult and the specialists say they cannot deal with it under this definition, perhaps this Committee ought to do its job by finding what word should be used and how, so that people can make those decisions. The noble and learned Baroness, Lady Butler-Sloss, will then not have to think too hard about whether it would be easier for her to make decisions under that proposal than under the one we have.
