37: After Clause 8, insert the following new Clause— “Increased penalties for littering offences(1) The Environmental Protection Act 1990 is amended as follows.(2) In section 88 (fixed penalty notices for leaving litter)—(a) in subsection (6A)(b)(i), for “£100” substitute “£125”;(b) in subsection (6A)(b)(ii), for “£75” substitute “£94”;(c) in subsection (8C) (England, Wales and Scotland versions), for “level 3” substitute “level 4”.”Member's explanatory statement This amendment seeks to increase penalties for littering and related offences. It raises fixed penalties in England and Wales by 25 per cent and moves the maximum fine levels up one tier on the standard scale.
