48: Clause 48, page 46, line 24, leave out “to be presumed to have been” Member’s explanatory statement This amendment would remove the rebuttable presumptions in new subsections (5ZA) inserted into section 72 of the Nationality, Immigration and Asylum Act 2002, so that a refugee convicted of a sexual offence would be considered to have been convicted of a particularly serious crime for the purposes of Article 33 of the Refugee Convention, therefore permitting their deportation.
