In contrast, the 1992 Act applies to collective bargaining at the local level between one or more locally recognised trade unions and one or more employers or employer associations. The bargaining covers matters such as allocation of work that are unlikely to be appropriate or relevant when negotiating at a sector-wide level. I assure the Committee that additional collective bargaining under the 1992 Act can continue to take place in individual workplaces, which allows employers and trade unions to agree more favourable terms than any minimum terms arising from fair pay agreements. I hope my justification for the existence of Clause 51 will satisfy the concerns of my noble friend Lord Hendy.
