If the central arbitration committee is fairly to balance the interests of workers, unions and employers alike, it must be given the tools to evaluate the practical consequences of the access being proposed. Without a clear statutory instruction to consider method and frequency, the committee may feel obliged to approve access on principle alone without regard to whether it is proportionate in practice.
