Indeed, if you go a little further into the examples that I gave earlier, what flavour would the Minister associate with “gummy bear”? Is it intended to taste of bear, or of gums? The two concepts of “flavour” and “flavour descriptor” are absolutely distinct. The Government need to be precise in what they are regulating. This is why I have a second amendment, Amendment 134, relating to Clause 91, which would substitute “flavour descriptor” for “flavour” in that clause. The Government could then focus their resources on the thing that does the damage, which as the noble Baroness, Lady Walmsley, more or less said—although for some reason she disagreed with my amendments—is the packaging, the advertising and the message on the box outside. It is not the taste on the inside, which is largely subjective, as I said, and bears no relation to what is on the outside.
