It is not quite like that, because the Foreign Office would have to issue special mission status to the person who would then come within the jurisdiction, and now that courts have clarified the law on special missions, that would give that individual immunity. As for the Attorney-General’s decision not to consent, there is a risk that that could be subject to judicial review, and there have already been attempts in that space. But I agree that that is a very important procedural requirement, and it is already in the Act.
