Northern Ireland Troubles Bill

A number of Members have mentioned the Stormont House agreement in connection with the Independent Commission for Information Retrieval. My party opposed the agreement because of the provisions that brought about an amnesty by default for all but murderers; at that point, it became a flawed expedition. Let me return to my earlier question to the Secretary of State. Clause 72(5) states: “The ICIR must not do anything which…would risk prejudicing, or would prejudice, the national security interests of the United Kingdom or Ireland.” It also states, in paragraph (c), that the ICIR must not do anything that “would risk having, or would have, a prejudicial effect on any actual or prospective legal proceedings in any part of the United Kingdom or Ireland.” In response to my intervention, the Secretary of State said that he would try to find the answer to my question by the time I made my speech, so I will ask him again: who makes the assessment that something will be prejudicial to the national security of Ireland, or to a prospective legal proceeding in Ireland? That is not in the remit of this Government or this place; nor will it, or should it, be in the remit of the ICIR. As yet, we do not know who the body corporate will be, and who will be part of it. I do not know whether the Secretary of State has found the answer to my question, but if he has not, he may wish to write to me.
